ForecaWeather Terms of Use and License
IMPORTANT. PLEASE READ CAREFULLY.
Subject to Your payment of the applicable fees due and provided that You are not otherwise in breach of these Terms of Use and License (“TERMS”), Foreca Oy (Business ID 1084243-9) (“Foreca”) hereby grants to You a nonexclusive and nontransferable, revocable right and license, to use the mobile weather service and thereto related software (“Service”) on one mobile device at any one time for the sole purpose of obtaining weather related information in a manner as decided by Foreca.
You may not (a) rent, lease, license, loan, assign, resell or otherwise transfer the Service; (b) modify, disassemble, decompile, or reverse engineer the Service; (c) use the Service in any way not expressly provided for in these TERMS or (d) otherwise compromise Foreca’s or its licensors’ rights in the Service. There are no implied licenses.
Foreca has made all reasonable efforts to ensure that all information and data provided through the Service are accurate at the time of publishing. Information and data on the Service are subject to constant updates and changes. Foreca cannot guarantee that any data or information, as seen by You at a specific date and time, will be retrievable later.
IN NO EVENT WILL FORECA BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES, LOSSES, OR LOST PROFIT RESULTING FROM ANY USE OR MISUSE OF THE SERVICE OR ANY INFORMATION, MATERIALS OR DATA AVAILABLE THROUGH OR ON THE SERVICE. IN NO EVENT SHALL FORECA’S AGGREGATE LIABILITY HEREUNDER, FOR ANY CAUSE ARISING OUT OF OR RELATED TO FORECA'S PERFORMANCE OR NON-PERFORMANCE UNDER THESE TERMS OR OTHERWISE, EXCEED THE PURCHASE PRICE PAID FOR THE SERVICE FOR A PERIOD OF ONE YEAR.
FORECA MAKES NO WARRANTIES (EXPRESS OR IMPLIED) OR REPRESENTATIONS WITH RESPECT TO ANY INFORMATION, DATA, OR MATERIALS ON THE SERVICE, THE SERVICE ITSELF, OTHER LINKED SITES OR SERVICES RELATING THERETO AND FORECA SHALL HAVE NO RESPONSIBILITY OR LIABILITY WHATSOEVER TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY INCONSISTENCY, INACCURACY, UNAVAILABILITY OR OMISSION WITH RESPECT TO ANY INFORMATION, DATA, MATERIALS, THE SERVICE OR SOFTWARE OR SERVICE RELATING THERETO. FURTHER, FORECA MAKES NO WARRANTIES (EXPRESS OR IMPLIED) OR REPRESENTATIONS WITH RESPECT TO THAT DATA AND INFORMATION OBTAINED THROUGH THE SERVICE WILL BE ERROR FREE, THAT DEFECTS WILL BE CORRECTED, THAT THE SERVERS THAT MAKE THE SERVICE AVAILABLE ARE FREE OF VIRUSES OR OTHER MALWARE. FORECA DOES NOT HAVE ANY LIABILITY FOR THE CONSEQUENCES OF THE DECISIONS MADE BASED ON THE DATA, INFORMATION OR MATERIALS OBTAINED THROUGH THE SERVICE.
The intellectual property rights (such as the trademarks, copyrights and rights to database) relating to the Service and any information, data and materials obtained through the Service are owned by Foreca and its licensors. You are not allowed to alter, modify, remove, copy, publish or transfer the items embodying the intellectual property rights (such as logos, pictures or data).
The software in the Service has a built-in license management module that helps You to avoid any unintentional violation of these TERMS. The license management module may transfer information on the existence of the license to Foreca over a network or over telecommunication connection for license monitoring of the Service.
The personal data Foreca may obtain from You while You utilize the Service Foreca will use for the purposes of (a) fulfilling its law related and agreement related rights and obligations, (b) market its products and services to You also by the means of sending direct electronic messages to You and to (c) develop and troubleshoot the Service.
The term of the right and license granted to You under these TERMS is a fixed term as defined separately in writing or electronically. You acknowledge and agree that if Foreca finds that the You have breached (a) any of Foreca’s or its licensors intellectual property rights in and to the Service or (b) any other material section of these TERMS Foreca has the right to terminate the right and license granted under these TERMS with immediate effect. Upon notification of termination You agree to immediately destroy the software of the Service on your device and discontinue using the Service. All provisions relating to intellectual property rights and limitations to liability and warranty in these TERMS shall survive any termination of the right and license granted to You.
You may not assign the right and license granted to You, by operation of law or otherwise, in whole or in part.
If any provision of these TERMS shall be held to be contrary to law, such provision shall be changed and interpreted so as to best accomplish the objectives of the original provision to the fullest extent allowed by law and the remaining provisions of these TERMS shall remain in full force and effect.
These TERMS are subject to the laws of Finland.
